Terms & Conditions

Please read these terms and conditions carefully before engaging in any services provided by Splash Design Studio, a graphic and website design business.

1. Scope of Services:
1.1. Splash Design Studio provides graphic design and website design services as outlined in the agreed-upon project proposal or contract.
1.2. All services provided are subject to the terms and conditions stated herein.

2. Client Responsibilities:
2.1. The client must provide clear and timely feedback during the design process.
2.2. The client is responsible for providing all necessary content (text, images, logos, etc.) required for the project, unless otherwise specified in the contract.
2.3. Any delays caused by the client in providing feedback or required materials may affect project timelines and deadlines.

3. Payments:
3.1. A deposit of 50% of the total project cost is required before work commences, unless otherwise agreed upon.
3.2. Final payment is due upon completion of the project, prior to the delivery of final design files or the launch of the website.
3.3. Payments must be made in the currency specified in the invoice, and any additional fees incurred (such as bank transfer fees) are the responsibility of the client.

4. Project Timelines:
4.1. Splash Design Studio will provide estimated timelines for project completion, which are subject to change based on factors such as client feedback, scope changes, or unforeseen circumstances.
4.2. Delays caused by the client may result in adjustments to project timelines, and Splash Design Studio shall not be held liable for any resulting consequences.

5. Intellectual Property:
5.1. Upon receipt of full payment, the client owns the final design files and website design.
5.2. Splash Design Studio retains the right to use any designs created for promotional purposes, unless otherwise agreed upon in writing.

6. Revisions and Alterations:
6.1. Minor revisions and alterations to the design are included in the project cost, as specified in the contract.
6.2. Additional revisions or major alterations requested by the client may incur additional charges, which will be outlined and agreed upon before commencement of the work.

7. Termination of Services:
7.1. Either party may terminate the services provided by providing written notice to the other party.
7.2. In the event of termination, the client is responsible for payment for all services provided up to the date of termination, as well as any outstanding expenses incurred.

8. Limitation of Liability:
8.1. Splash Design Studio shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the services provided.
8.2. In no event shall Splash Design Studio’s total liability exceed the total amount paid by the client for the services provided.

9. Pay Monthly Website Design:
9.1. Splash Design Studio offers pay monthly website design plans, where the client pays a fixed monthly fee for the design, development, and maintenance of their website.
9.2. The client agrees to the terms of the specific pay monthly plan chosen, including the duration of the contract and any applicable cancellation fees.
9.3. Monthly payments for the pay monthly website design plan are due on the agreed-upon date each month, as specified in the contract.
9.4. Failure to make monthly payments may result in the suspension or termination of services, and Splash Design Studio shall not be liable for any consequences resulting from such suspension or termination.
9.5. The client acknowledges that ownership of the website design remains with Splash Design Studio until the final payment is made, at which point ownership is transferred to the client.
9.6. Any additional features or services requested by the client during the pay monthly contract may incur additional charges, which will be outlined and agreed upon before commencement of the work.
9.7. The pay monthly website design plan includes ongoing maintenance and support as specified in the contract. Any additional support or maintenance beyond the scope of the plan may be subject to additional charges.
9.8. The client understands that the pay monthly website design plan is subject to the terms and conditions outlined herein, as well as any additional terms specific to the chosen plan.

10. Governing Law:
10.1. This Agreement shall be governed by English Law.

By engaging in our services, the client agrees to be bound by these terms and conditions. Splash Design Studio reserves the right to modify these terms and conditions at any time, and such modifications shall be effective upon posting on our website or providing notice to the client.
